By contacting GS, raising questions or comments to GS’s representatives, using GS's products and/or services through the Website or otherwise, GS processes the Personal Data of its users. This includes, among other elements, name, address details, date of birth, contact details such as email address and telephone number. In addition, financial data, such as a bank account number and details regarding (purchased) products and/or services such as a booking number, travel duration, destination and information about health conditions, allergies and dietary preferences may be processed if a user purchases a paid product and/or service (for example a journey) from GS if and to the extent that this data is necessary for the payment of the relevant product and/or service or further administration and performance of the paid product and/or service.

The processing of Personal Data takes place in the following cases:

for the conclusion and execution/performance of an agreement with the user for example if the user books a journey;
for administrative processing;
to offer and/or provide the user with the agreed products and/or services;
for invoicing if it concerns one or more paid products and/or services. If payment is not made for our products and/or services, we may hand over the claim to third parties, such as a collection agency;

In the aforementioned cases (a)-(e) Personal Data such as the name, address, email address, telephone number, bank details and details regarding (purchased) products and/or services such as booking numbers, travel duration, destination and information about health conditions, allergies and dietary preferences are necessary for the performance of the agreement/arrangements with the user.

In the aforementioned cases (a)-(l) as well as other possible scenarios subject to applicable legislation, GS has a legitimate interest in processing the Personal Data concerned. The Personal Data provided are processed by GS solely for the purpose of implementing its products and/or services and, in particular, for the explicit purpose for which these Personal Data were collected.

If a user purchases GS's products and/or services, for example by booking a journey through the Website for or on behalf of various other persons, that user must ensure that these other persons concerned are informed about this Privacy Statement and permit that user to submit their Personal Data to GS in accordance with this Privacy Statement. GS retains/stores Personal Data and Usage Data in its customer database or other (digital) databases. GS will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Statement. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain Your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. GS will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of the Website or GS is legally obligated to retain this data for longer time periods.

Personal Data is processed at GS’s operating offices, in various IT-systems that are used within the organisation and in/at any other places where the parties involved in the processing are located. Various IT-systems are installed internally at GS such as our customer database, booking and sales support systems and our data management system. Other IT-systems are cloud solutions and/or are installed at third party suppliers to which Personal Data may be transferred respectively disclosed. Further, Personal Data may be transferred or disclosed to third party payment providers or other contracting parties that deliver services to GS to perform a booked journey respectively to execute the product and/or service purchased by the user. Transfer or disclosure of Personal Data is always subject to adequate controls including the security of data and other personal information and subject to GS’s instruction to process such data.

As referred to above, Personal Data and information may be transferred to and maintained in IT-systems, digital clouds or on computers of third parties that may be located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction. Your data will not be transferred outside of the EU. Your consent to this Privacy Statement followed by Your submission of such information/Personal Data represents Your agreement to that transfer. GS will take all steps reasonably necessary to ensure that Personal Data is treated securely and in accordance with this Privacy Statement and applicable legislation and that no transfer or disclosure of Personal Data will take place to an organisation/a third party or a country unless there are adequate controls in place including the security of data and other personal information.

GS will not disclose the Personal Data of its users to third parties unless (i) this is necessary for the performance of its products and/or services (such as the performance of a booked journey), (ii) to protect and defend the rights or property of GS, (iii) to protect against legal liability, (iv) to prevent or investigate possible wrongdoing in connection with the Website, (v) pursuant to a legal requirement or (vi) in an emergency to the extent that, in GS's reasonable judgment, it is in the best interests of its users.
